By accessing this site or placing an order on Adam's Eden you agree to these Terms of Service. If you do not agree, please do not use this site.
Who We Are
Adam's Eden is a working homestead in Radcliff, Kentucky, operating as a node on the Free Market Protocol. It is an unincorporated farm business. Everything we list is grown, saved, or assembled here and shipped direct to customers in the United States — seeds, live plants, fresh produce, and growing supplies.
Eligibility & Age
You must be at least 18 years old to place an order, since placing an order forms a contract and authorizes a payment. If you are between 13 and 18, you may use this site only with the involvement and consent of a parent or guardian, who agrees to these Terms and is the responsible party for any order placed.
We do not knowingly allow children under 13 to create an account or place an order. See our Privacy Policy for how we handle children's information.
Living & Perishable Goods
Seeds, live plants, and fresh produce are living agricultural products, not manufactured goods. They are grown by hand, vary naturally from one specimen to the next, and — in the case of plants and produce — are perishable and sensitive to time and handling. Nothing is listed until it exists and is ready to ship. Because of their living nature, these items are handled under special return terms; see our Refund & Return Policy.
Seeds & Germination
Seeds are sold as viable at the time they ship, packaged by variety and lot. Germination and yield depend on your own growing conditions — soil, water, temperature, timing, and care — which are outside our control, so we cannot guarantee that any seed will germinate or that any crop will succeed. Many of our lines are open-pollinated or heirloom; saved seed naturally shows some variation. We are not responsible for crop outcomes.
Orders & Payment
All prices are in US dollars. Payment is processed securely by Stripe. We do not store your card details. An order is confirmed when you receive a confirmation email from us.
We reserve the right to cancel any order if an item is out of stock, mispriced, or — in the case of plants and produce — if a crop fails or is not fit to ship. A full refund will be issued immediately in that case.
Taxes
Listed prices do not include sales tax. Any applicable state and local sales tax is calculated and shown at checkout based on your shipping destination, and is collected and remitted where we are required to do so by law. You are responsible for any tax shown on your order.
Shipping & Agricultural Restrictions
We ship to US addresses only. Orders are processed as quickly as the goods allow — perishable items are harvested or pulled to order. Shipping estimates are provided by the carrier and are not guaranteed.
Some states and localities restrict the shipment of seeds, live plants, or soil to protect against pests and disease. You are responsible for knowing and complying with the agricultural rules of your own state and locality, and we may be unable to ship certain items to certain destinations. Returns and transit-loss claims are handled under our Refund & Return Policy.
Variety Representation
We describe each variety honestly and to the best of our knowledge from our own growing records. Natural variation in living plants — in size, color, vigor, and timing — is inherent to the hobby and to farming, and is not considered misrepresentation.
Accounts & Identity
You may create an account using an email address or an Ethereum wallet. Account holders on the Free Market Protocol receive an Auth-Key — a soulbound NFT identity that persists across all protocol nodes. You are responsible for keeping your login credentials secure and for all activity under your account.
Intellectual Property
The Adam's Eden name, logo, site design, photographs, original written content, and the plant genetics and breeding lines we develop are our property and may not be copied, propagated for commercial resale, or reused without permission. Variety names that are common or generic to the gardening community are used only to identify what we grow.
Prohibited Use
You may not use this site for any unlawful purpose, to submit false orders, or to attempt to exploit pricing errors in bad faith. We reserve the right to refuse service to anyone.
Disclaimer of Warranties
The site and our products are provided "as is." Living goods carry inherent natural variability, and we make no warranty of germination, yield, or growing performance beyond viability at the time of shipment. To the fullest extent permitted by law, we disclaim all other warranties, express or implied.
Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including lost crops or garden outcomes.
Indemnification
You agree to hold Adam's Eden harmless from claims or expenses arising out of your misuse of the site or your violation of these Terms.
Governing Law
These Terms are governed by the laws of the State of Kentucky, without regard to its conflict-of-laws rules. Any dispute that is not otherwise resolved will be brought in the state or federal courts located in Hardin County, Kentucky.
Severability & Entire Agreement
If any part of these Terms is found unenforceable, the rest remains in effect. Together with our Privacy Policy and Refund & Return Policy, these Terms are the entire agreement between you and Adam's Eden regarding your use of the site.
Changes
We may update these terms from time to time. The current version will always be posted at this URL. Continued use of the site after changes constitutes acceptance.
